§1 Definitions and Terms Used in These Terms and Conditions

Terms and Conditions: This document defining the rules for using services and concluding sales contracts on the fashionista-trends.com website.

Store: The online service fashionista-trends.com, including its subdomains, enabling order placement and service usage.

Content: Photos, product descriptions, graphics, and other materials available on the website, which are the property of entities mentioned in §11.

Electronic Services: Services provided by the online store, such as account creation and newsletter subscription.

Account: Customer panel enabling data editing, order tracking, and contact with creators.

Shopping Cart: Service enabling adding products, selecting delivery, payment methods, and using discount codes.

Newsletter: Service through which customers receive emails with information about promotions and new products.

Custom Product: Products made to order according to customer specifications.

Seller: Store owner Mateusz Kulesza, contact: kontakt@fahionista-trends.pl.

Customer: Any natural person, legal entity, or other entity placing orders.

Consumer: Natural person making purchases unrelated to professional activity.

Creator: Person or group of persons creating products sold in the store.

Product: Movable item or digital content available in the store, such as files, courses, e-books.

Order: Customer’s declaration specifying product, its characteristics, quantity, and data needed for fulfillment.

Sales Agreement: Agreement between seller and customer concluded in the online store.

Discount Code: Code providing percentage discount on order value.

§2 General Rules and Provisions

Scope of Terms: These Terms and Conditions define the rules for using the fashionista-trends.com online store.

Seller Information: The store is operated by Marlena Stawecka, ul. Nieszawska 149C, apt. 16, 87-720 Ciechocinek, Poland, Tax ID: 8911031481. Contact: kontakt@fahionista-trends.pl or phone: +48 605979022.

Recipients: These Terms apply to both consumers and other customers using the store or its services.

Terms Acceptance: Acceptance of these Terms is voluntary but necessary for placing orders, creating accounts, newsletter subscription, and using services such as custom products.

Logistics: Products are sold retail and through dropshipping system. This means orders may be shipped from different locations.

Product Condition: All products are new, defect-free, and legally introduced to the market. Products are handcrafted by artisans with due care.

Offer: Information on the store website is an invitation to conclude a contract, not a binding offer under applicable law.

Technical Requirements: To place an order, customer needs an active email address and internet-enabled device (e.g., laptop, phone).

Product Usage: Products should be used according to their intended purpose. Children should only handle products under adult supervision. Seller is not responsible for improper use.

§3 Electronic Services Available in the Store

Available Services: Customers can use the following functions in the store:

  • Browsing website content
  • Account creation and management
  • Using shopping cart
  • Placing orders and concluding sales agreements
  • Receiving targeted advertising content
  • Newsletter subscription
  • Ordering products according to custom specifications
  • Contacting creators through contact form or website chat

Account Creation: Account can be created after filling out the form and accepting terms. Account is free, and the service agreement can be terminated at any time by sending email to kontakt@fahionista-trends.pl. Account creation is not required for placing orders.

Shopping Cart: Cart activates after adding first product and allows order management. It’s free and works once per order placement.

Customer Obligations: When using the store, customer agrees to:

  • Provide true and current information
  • Update information when it changes
  • Use store services without disrupting store operation or other customers
  • Pay for and collect orders on time
  • Not introduce content prohibited by law and not use tools automating orders
  • Not interfere with store functionality and not copy content without permission

Complaints: Complaints regarding electronic services can be submitted via email to kontakt@fahionista-trends.pl or by mail to the store address. Seller processes complaints within 30 days.

§4 Sales Agreement Terms

Agreement Conclusion: Sales agreement is concluded after customer places order and seller confirms it.

Orders: Customer can order multiple products in one order. Orders can be placed through fashionista-trends.com website or email 24/7 throughout the year.

Ordering Process:

  1. Add products to cart: Select products, check prices, add discount codes, choose delivery method
  2. Fill in details: Provide correct contact information and delivery address
  3. Summary: Choose payment method and accept terms
  4. Payment: Make online payment or bank transfer

Order Confirmation: After placing order, customer receives email or SMS confirmation. Seller may accept or reject certain products in the order and inform customer accordingly.

Order Status: Seller informs about order status via email or phone.

Order Fulfillment Issues: Seller may contact customer in case of:

  • Product unavailability
  • Incomplete order information

Order Cancellation: Customer can cancel order, which releases seller from fulfillment obligation. If seller cancels order, money is refunded within 14 days.

Prices and Delivery Costs: Prices are listed in Polish Złoty and don’t include shipping costs, which are visible in cart. For orders from multiple craftspeople, customer bears cost of each separate delivery.

Total Order Value: Price includes products, delivery costs, and optional paid services. Customer is informed during order placement.

§4.1. Digital Product Purchases

Purchase Form: Digital product purchase involves licensing content use according to copyright law.

Right of Withdrawal: Consumer loses right of withdrawal after downloading file or accessing content (according to applicable consumer protection laws).

Product Delivery: Digital product is delivered to email address provided by customer during order placement.

Technical Issues: In case of access problems, customer may file complaint, which will be processed according to applicable law.

Copyright Protection: Copying, distributing, or sharing digital products without copyright owner’s consent is prohibited.

§5 Delivery Methods, Costs, and Terms

Delivery Methods: Available delivery methods can be checked on fashionista-trends.com in the “Delivery” section.

Order Fulfillment: Order is shipped after paying full price for products and delivery, unless “Cash on Delivery” option is selected or delivery costs are covered by seller. Orders are fulfilled in Poland and European Union.

Delivery Time: Stated delivery time refers to business days (Monday to Friday) and excludes statutory holidays.

Delivery Responsibility: fashionista-trends.com store is not responsible for non-delivery in case of:

  • Incorrect address provided by customer
  • Customer not collecting package without prior notification of such possibility

Return Costs for Undelivered Orders: In justified cases, seller may refund amount paid by customer, reduced by 30 PLN (approximately €7), representing return cost and product re-acceptance into inventory.

§6 Payment Methods and Terms

Available Payment Methods: a) Advance Payment:

  • Online Transfer, BLIK, Google Pay
  • Payment cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro
  • Traditional bank transfer to seller’s account

Payment Information: Details of available payment methods are in “Payment Methods” section on fashionista-trends.com and in shopping cart during order placement.

Payment Redirect: When choosing Online Transfer, BLIK, Google Pay, or payment card, customer is redirected to payment service provider’s page.

Payment Reminder: In case of non-payment, seller may contact customer (email or phone) for reminder.

Non-Payment:

  • Electronic and card payments: lack of payment within 24 hours results in order cancellation
  • Traditional transfer: lack of payment within 3 days causes order cancellation, and in case of later payment, money will be refunded to customer’s account

Non-Collection of Product: In case of non-collection with advance payment, sales agreement is terminated and payment refunded (except for non-prefabricated products created to customer order).

Proof of Purchase: Seller issues personalized purchase document (e.g., invoice) electronically, sent to email address provided with order.

Payment Refunds:

  • Online Transfer, Google Pay, BLIK: refund to customer’s bank account
  • Payment cards: refund to account associated with card

§7 Custom Product Service

Service Scope: Service allows customer to order product made according to their specifications via email or phone.

Agreement Conclusion: Sales agreement is concluded after establishing order conditions (specifications, price, delivery form and cost, fulfillment time) and customer acceptance of terms.

Payment: Customer must pay order in advance by traditional transfer to account specified on store website. Lack of payment within 3 days results in order cancellation. In case of later payment, money will be refunded to customer’s account.

Order Confirmation: After receiving payment, seller sends order acceptance confirmation and fulfillment information (status “Awaiting fulfillment”).

Right of Withdrawal: Right of withdrawal doesn’t apply to products created to order according to customer specifications (according to applicable consumer protection laws).

Order Status Information: Seller may inform customer about order progress via email or phone.

Fulfillment Time: Fulfillment time is individually agreed with customer when concluding agreement.

Proof of Purchase: Seller issues personalized purchase document (e.g., invoice), sent electronically to customer’s email.

§8 Withdrawal from Agreement (Product Return)

Right of Withdrawal: Consumer has right to withdraw from distance contract without stating reasons within 14 days of receiving product.

Withdrawal Period: 14 days counted from day of product delivery to consumer. For multiple product delivery – from delivery of last product.

Withdrawal Method: Customer submits written statement to store address or sends via email to kontakt@fahionista-trends.pl. Sample withdrawal form is available on store website in “Returns and Complaints” section.

Withdrawal Effects: Agreement is considered not concluded. Product must be returned in unchanged condition, unless change resulted from necessity to check product.

Product Return: Customer has 14 days to return product after withdrawal notification. Return should be in original condition with proof of purchase. Customer covers return shipping costs.

Customer Responsibility: Customer is responsible for product value decrease if used beyond what’s necessary to determine product characteristics and functions.

Money Refund: Seller refunds payment within 14 days of receiving statement and product return or proof of shipping.

Return Exceptions:

  • Products made to customer order according to their specifications are not returnable
  • Digital products are not returnable after downloading file or accessing content

Order Cancellation Before Shipping: Customer can cancel order without consequences before shipping by contacting seller or creator.

§9 Warranty Claims

Claim Basis: Customer may file complaint based on warranty defined in applicable Civil Code provisions.

Seller’s Obligation: Seller must deliver product free of defects.

Product Defects: Product is considered defective if:

  • Not compliant with description on store website
  • Has defects reducing its value or usefulness

Customer Rights: Customer may demand:

  • Product repair
  • Replacement with new product If impossible, customer has right to:
  • Price reduction
  • Withdrawal from agreement

Claim Time: Warranty claims can be filed within 2 years of purchase.

Filing Claims: Claims should be filed to seller’s address provided on store website in “Contact and Transfer Details” section or in terms. Procedure details are in “Returns and Complaints” section on store website.

Claim Processing: Seller processes claims within 14 days of filing.

Shipping Costs: If claim requires defective product return or repair, seller covers shipping costs.

Digital Product Claims: Customer may claim digital file if damaged, inaccessible, or not compliant with description. Seller will provide correct file or renewed access to content. If repair impossible, customer has right to demand price reduction or withdrawal from agreement.

§10 Privacy Policy and Personal Data Processing

Data Controller: Personal data controller is the seller. Contact details are in terms introduction.

Data Voluntariness: Providing personal data is voluntary but necessary for sales agreement conclusion, account creation, and store service usage.

Data Processing: Data is processed according to applicable data protection regulations (GDPR). Customer has right to:

  • Access their data
  • Rectification, erasure, processing limitation
  • Withdraw processing consent
  • Data portability
  • Object to processing

§11 Copyright, Licenses, and Content Usage

Store Content: Content on fashionista-trends.com website, such as photos, graphics, and descriptions, are:

  • Seller’s property
  • Created by craftspeople responsible for product descriptions and photos
  • From free graphic databases (e.g., Pexels, Flaticon) used according to their licenses

Personal Use: Customer may use store content exclusively for personal use and proper store usage. Other uses require written consent.

Digital Products: Purchased digital products (e.g., e-books, courses) are copyright protected. Customer acquires license exclusively for personal use. Copying, distributing, or commercial use is prohibited without rights owner consent.

§12 Store Reviews

Review Possibility: Customer may voluntarily and free of charge provide reviews of purchased products. This may be rating, review, or product photo.

Review Condition: Reviews may only be provided by customers who actually made purchases in the store.

Review Publication: Reviews are published on store website and available to visitors.

Review Usage Rules: Reviews cannot be used for unlawful activities, including:

  • Unfair competition acts
  • Violation of personal rights, intellectual property rights, or other rights of seller and third parties

Review Truthfulness: Reviews may only concern actually purchased products. False transaction-based reviews are prohibited.

Seller Review Prohibition: Seller and employees (regardless of employment form) cannot provide product reviews.

§13 Service Agreement Termination and Terms Changes

Termination by Seller: Seller may terminate agreement with one-month notice for important reasons, such as law changes, technical needs, or Store functionality changes. If Customer doesn’t use Account for 3 years, Seller may terminate agreement immediately.

Notifications: Information about agreement termination or Terms changes is sent to Customer’s email address.

Terms Changes: Terms may be changed due to law changes, technical needs, or new Store functions. Customer is informed about changes via email and publication on Store website.

Change Acceptance: Changes take effect 14 days after notification. Customer may terminate agreement within 14 days of change notification. Lack of objection means change acceptance.

Account Terms Changes: Account terms changes result from necessity to adapt to law, improve security, or introduce new functions. Customer will be informed about changes 7 days in advance and has right not to accept new rules, which will result in agreement termination.

Customer Rights: Customer may terminate Account agreement at any time if disagreeing with new rules. Termination leads to Account closure.

§14 Final Provisions

Language: All agreements with Seller are concluded in English.

Terms Availability: Terms are available free of charge on Store website at: https://fashionista-trends.com/terms-conditions

Connection Costs: Store usage may involve internet or telephone connection costs depending on Customer’s service provider tariff.

Applicable Law: For matters not regulated in Terms, applicable law applies, including Civil Code, electronic services law, and consumer rights law.

Consumer Protection: Consumers have rights granted by applicable consumer protection laws, which we as fashionista-trends.com Online Store fully respect and apply. Consumer protection law provisions take precedence in case of unintended non-compliance in these Terms provisions.

Dispute Resolution: Disputes arising from Terms or agreements with Seller will be resolved by competent courts according to applicable civil procedure code.

International Considerations:

  • For customers outside Poland/EU, additional customs duties and taxes may apply
  • Delivery times may vary for international orders
  • Currency conversion rates apply for non-PLN payments
  • Local consumer protection laws may provide additional rights
